At the last New York State Fair, back in 2019, a certain orange drink was creating a bit of a buzz.

It was Cuse Juice. Earlier that summer, the liqueur made by Lock 1 Distilling Co. of Phoenix in Oswego County grabbed headlines when it ran afoul of trademark lawyers from Syracuse University.

SU objected to the distillery’s use of the word “cuse.” Lock 1 decided not to fight, and agreed to withdraw it from the market by that fall. But there was still product out there, at stores and bars.

And throughout the 2019 fair, you could find Cuse Juice on its own or in mixed drinks across the fairgrounds.

Remarkably, the original that caused all the fuss is still around for the 2021 fair, but in more limited areas. (That’s not counting Lock 1′s new EXCUSE liqueurs, which replaced it).

This year Daniella’s, the restaurant that has taken over the former Empire Room space at the fair, is Cuse Juice headquarters. And you can also find the original liqueur in a drink at the New York Brew Pub & Distillery location at the east end of the Midway.

Daniella’s has a stash of 35 cases of original Cuse Juice, said Brian Stolusky, the restaurant’s manager. Most will be used to make Cuse Juice Slushies at the indoor bar (the former Empire Room bar) and in a tent nearby.

The slushies are made with Cuse Juice liqueur and Lock 1′s Ryze Vodka, mixed with orange-flavored crushed ice and topped with whipped cream and sprinkles.

In 2019, Daniella’s owner Charlie Roman said “the Fair could use a little controversy” when introducing the drink. This year, he said, “If you want the real Cuse Juice experience, come here.”

Since last year, Roman has operated a year-round restaurant called Daniella’s Fresh Seafood & Pasta House in the former Empire Room (and he still has the Daniella’s Steakhouse on State Fair Boulevard near the Fairgrounds). It’s open during the fair, when Roman also operates a separate Daniella’s food stand near Gate 4.

At the New York Brew Pub and Distillery, the authentic Cuse Juice is also an ingredient in the Orange Cuseicle, a mix of the liqueur with whipped cream and topped with an orange slice.

Lock 1 Distilling, meanwhile, has its own stands, one just outside Daniella’s/The Empire Room and another in the Horticulture Building, but they aren’t selling Cuse Juice, or any cocktails.

Lock 1 is sampling and selling their line of spirits, including a new set of liqueurs introduced last year. Those are called EXCUSE (get it?). They come in various tropical flavors, including pineapple, mango and coconut, and, of course, orange.

The Orange EXCUSE version of the liqueur is the the principal ingredient in a drink at Tommy C’s stand in the Colonnade. It’s called the Orange Crush, subtitled “Give Jim B. His 100 Wins Back.” It’s a mix of Orange EXCUSE with Sprite, a dash of grenadine and an orange slice.

And you’ll find Lock 1 products at stands across the fairgrounds, including the Tiki Turtle in the Colonnade and the West End Ale House at the far side of Restaurant Row.

If you’re craving that unvarnished taste of the original Cuse Juice, go ahead and try the Lock 1 Orange EXCUSE. The label is different from the original but it’s the contents that count, right?

“It’s the exact same product,” Lock 1 co-owner Steve Dates said.
